Cela leur permet donc de b\u00e9n\u00e9ficier d\u2019un nouveau d\u00e9part (\u00ab\u00a0Fresh Start\u00a0\u00bb).<\/p>\n<h4>Proc\u00e9dure:<\/h4>\n<p>En cas de faillite d\u2019une personne physique, celui-ci peut d\u00e9poser une requ\u00eate en effacement de dettes. Le Tribunal devra alors se prononcer sur cette demande d\u2019effacement de dettes au plus tard \u00e0 la cl\u00f4ture de la faillite.<\/p>\n<p>Le failli peut obtenir l\u2019effacement de toutes ses dettes, \u00e0 l\u2019exception des dettes alimentaires et des dettes r\u00e9sultant d\u2019une obligation de r\u00e9parer le dommage fautivement caus\u00e9 suite au d\u00e9c\u00e8s ou \u00e0 l\u2019atteinte \u00e0 l\u2019int\u00e9grit\u00e9 physique d\u2019une personne.<\/p>\n<p>L\u2019effacement b\u00e9n\u00e9ficie \u00e9galement au conjoint, l\u2019ex-conjoint, le cohabitant l\u00e9gal et l\u2019ex-cohabitant l\u00e9gal qui est personnellement oblig\u00e9 \u00e0 la dette du failli contract\u00e9e du temps du mariage ou de la cohabitation l\u00e9gale, pour autant qu\u2019il s\u2019agit d\u2019une dette li\u00e9e \u00e0 l\u2019activit\u00e9 \u00e9conomique du
